Hello,
I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.

It was a nightmare for few weeks but, long story short...I got my new passport after the Embassy cannot find my original I sent for renewal. Please let me know if I need to get it stamped within any timeframe. My current I-797 expires MAY 2010. I have an approved 140 and EAD but my attourney suggested to stay on H1B.
Appreciate your feedback and help in this matter.

You dont need a visa stamp on your new passport unless you want to use it to re-enter US when you travel. There is no time line associated with getting a visa stamp. You just need to make sure you keep extending your H1 status and get an I-94 with the extension approval. If you have an AP you can use it for re-entering and still can continue working on H1 for the same employer. Else, when you travel the next time, you can setup a visa appointment and get H1 stamped on your new passport.

Hi,
I need some clarification/suggestion regarding my status.
I came to US on F1 and am currently working on H1-B (never got H1 stamping) and I got married here in US. I applied for 485 as dependant with my spouse and I got my EAD/AP. I am still continuing on my H1-B without using EAD. We are planning to go to India in Dec and I prefer to use my AP while entering US and would like to continue working on my H1 (continue with same employer) after coming back. Is it possible and valid to do like that? If its ok, do I need to submit any form or anything to USCIS informing that. I prefer not to use EAD. Hope I am clear explaining my situation. Please suggest.

My Lawyer asked for the original letter from employer. She didn't even accept the scanned copy. I had to mail the letter to my lawyer.

My 6 years H1B visa term is expiring on Apr 30th 2008. My company filed 3 years of extension on approved I140 basis, which is still pending as of Apr 30th 2008. And my I 94 is dated till Apr 30th 2008.
I filed my I 485 in June 2007 and got EAD and AP
1) What will be my status after Apr 30 2008. Will I still be on H1 status, if not what will be my status.
And what is 'H1 pending for 240 days rule'.

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

Applying AC21 will trigger the IO to update the case, and if all is fine, in some case, the case could be approved, though not at all time, You can try your luck, In July when all cases were current happened to a colleague with PD2004, the case was approved in a week after mailing AC21. Check with an Attorney.

It's ok to join new company as long as the transfer application was delivered to the USCIS. I got the fedex receipt from the new company and I am ok with it.

If your application gets approved before/on 30th June you will get 1 year EAD. If this happens after/on 1st july you should get 2 years. I am in same senario.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.

Though I am not an attorney, I would recommend removing the word "revoke" from the letter. Some less knowledgeable IO can read "revoke" along with "I-485" and do something disastrous.
