Can anyone be kind enough to tell me how to talk to a real person at the Vermont Service center? It has been over a month since my employer received the receipt number from USCIS, but the case cannot be found online. I tried calling the number below, but the robot that talks says the same detais that I can find online.
"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."

I just went to Mumbai for H1 stamping and my previous visa on the passport had expired in 2006. So even if you are going for H1 stamping but your visa on the passport has been expired for more than 12 months...then you have to answer NO for this question.

Hello Friends,
I am a new member and i am planning to join company. How long will take to tranfer visa from AAA to BBB? and one more doubt, is there any limitation to file Labour because i haven't file labour by current company. my new company may be filling my labour would take 3 to 4 months. is that making any problem to file labour after few months?

I-140 approved. I haven't applied for I-140 yet.
I am looking to move to different position with similar job responsibilities within my company.
I spoke to company's internal legal dept - and as per them they would require -
a) My current job responsibilty as filed on GC app
b) New Job responsibilties from new manager
c) A note from new manager stating that new job responsibilities are similar to current one.
With this documentation, I could use my existing I-140 & don't have to file for H1-B, labor & I-140 again.
Do I need to be concerned for anything else?

If you have e-mails that's good enough. No need to be scared, if you feel that you have not done anything illegal there is nothing to be afraid of. If your prev. employer starts to threaten in any way play it smart and try and get him to write e-mails, you can use that against him. Always consult a lawyer first to discuss the pro's and cons.

You have some good pictures, but I agree you would more easily get responses here if you include pictures in your post. One critique I can give is you should watch the level of your horizons, it's a pet pieve of mine as some here know :), I'm sensitive to leaning pictures.

Nearly 300 illegal immigrants with criminal convictions were arrested last week in Texas, the Dallas Morning News (http://www.dallasnews.com/sharedcontent/dws/news/texassouthwest/stories/022510dnmeticeraids.1572cfa1e.html) reports. The largest number of arrests, 119, were in North Texas. According to the article:
Of the total, about half of the immigrants had convictions for violent crimes or drug offenses. Most of the crimes were committed in the United States, authorities said.
The arrests, though, raises questions about why the immigrants hadn’t been deported earlier, immediately after they'd served their time for criminal convictions.
A new program, called Secure Communities, seeks to link jail staff with federal data banks to ensure that those with criminal convictions are removed from the country. There are only 110 jail locations in the country that now use the program.
Secure Communities has come under scrutiny for the relatively low number of persons caught who have been convicted of violent crimes – or what’s known in ICE as a "level one" offense.
Carrollton, Farmers Branch, Irving, Mesquite and Dallas and Denton counties are among the jurisdictions using Secure Communities processes. The program began in November 2008.

But this time there are 90+ dems and Reps co-sponsored this bill..so chance of this getting passed is enormous and I was hoping since this is the child of those claiming to be the champions of the legal immigration ..could probably insert something to bring relief to the legal community..

Hello everybody,
First of all I must appologize because I mentioned this in the forum before but that was a different question that I asked.
My wife's Labor lists a 4 year degree with a BS in Mechanical Engineering as a requirement.
We filed I-140 with her old H1B evaluation which says she has a 4 year degree in Civil Engineering (stupid me :mad: ).
I found another evaluator who looked closely and gave us an evaluation for BS in Mechanical Engineering because her degree is way closer to the Mechanical than it is to the Civil Eng.
Will USCIS reject this I-140 on the spot based on the fact that she doesn't meet the requirements or issue an RFE ? If they issue an RFE and we send the Mechanical Eng. evaluation, will the fact that we filed first with the Civil Eng evaluation cause any problems ? Are we assuming the worst and is not such a big deal ??
She worked on H1B for 7 years as a Mech Eng and this is NOT a labour substitution.

I thought this will be a useful information to everyone.
My Case,
04/18/2008 -Applied EAD online
06/19/2008 -Status changes to "Approved" but no Notice sent.
07/20/2008 -Waited for 30 Days and called USCIS to open a Service Request.
07/24/2008 - Received EAD at home.
08/26/2008 - Received the letter from USCIS saying we have sent you the card but never received back or delivered to you hence concluding it is considered lost and if you need it, Please file for EAD again.
I called USCIS, Customer server rep said take an Infopass appointment to make sure it is valid.
Took the appointment, went USCIS on 09/10/2008.
Officer takes a look and tells me "Obviuosly you have EAD in your possession and unless you made it up on a color Laser printer, It is my fault that I have provided wrong information to USCIS and not waited for 30 days as I should have and I am there to pick up a fight with USCIS,bla bla bbla"
I remained very calm knowing he does not like his job but have to do it.
He is rude and clueless at the most why I am there. My first experience with USCIS, I dont think I want to go to their office again.
Finally conclusion he tell me "Once EAD is issued it remains VALID until you notify USCIS that it is lost or stolen or tempered with, USCIS DOES NOT take any proactive actions on EADs that are issued. Hence NO action is neccessary at this time"
Moral of Story is DO NOT go to USCIS if you receive such type of letter from USCIS after opening a service request for EAD.
I wasted a good amount of time and money just to take this BS.

The minimum requirements for a particular job may, and often do differ from the minimum requirements for EB-2 classification. As long as the actual requirement for a given positon is at least a Master's Degre or equivalent (defined as a Bachelor's Degree plus at least five (5) years of progressively responsible relevant experience), then the position qualifies for EB-2 classification.
The labor certification and I-40 Immigrant Visa Petition will not be approved unless the beneficiary is able to document education and experience meeting or exceding the actual minimum requirements for the job as set forth on the application for Labor Certification.
