Jan'09 : My Employer submitted 7th year H1B extension - Vacation Recapture + Extension based on pending I-140
Feb'09 : RFE was issued asking information related to Company
Feb'09 : H1B - 6 Years completed : H1B Visa / I-94 Expired in Passport
Mar'09 : RFE responded with the requested information
Apr 10, 2009 : USCIS Denied H1B Extension petition.
I understand from my employer that I can no longer be on the US payrolls and that I've to leave the country in 180 days.
Is Motion to Reopen (MTR) / Appeal is an option to legally stay in US ? If MTR is submitted, can I continue to work for the employer / client and get paid ?
Appreciate your inputs in this area.

Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

MTRs can take months or years. There is no 60-day processing time. The prior poster's answer of a few years is not unusual.

You can move you H1B visa from Company A to Company B. Talk to your attorney. Because you already have an approved H1 you will not be subject to H1 cap while applying for H1 through Company B.
I do not think Company A can apply for a H1 extension based on I140 and I485 of comapny B. But ask your attorney as to what your options are

They do (3 years old info). Make sure you ahve all the documents that are mentioned in their checklist. They will give you the visa with the expiry date based on your I-94.

If anyone is planning to drive from CT for the rally or is not driving because they are unsure, or not motivated enough... then here is your chance.
We can join together and go to DC and come back together. I am planning to go on Monday 17th morning. Ill be coming from New Haven/Hamden area in CT.
If anyone is planning to go in the evening, we have a BUS service available also. We are starting 6:30 PM from Woburn, MA on the 17th and should be reaching Hartford at around 8:15 - 8:30 PM, New Haven at about 9:00 - 9:15 PM.

Also if you are on highways 84 and 91, let us know, as we can pick you up on the way.

My consulting company with whom my H1B exists and to which my wife's H1B to H4 transfer is planned, have sent me the required documents "I539, Application to Extend/Change Non-immigrant Status" and asked me to send them to USCIS myself.
Is this fine ?

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Yeah many people got the I-140 update who files in July. What was your PD on LC Sub? If you pD was too old then you would have got your GC by now.

I have a certain queries regarding the transfer from L2 to H1B.
My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?

I believe NameCheck must have been initiated. As far as processing 485 is concerned, does the PD have to be current?
